Islamabad: Chief Justice of Islamabad High Court (IHC) Justice Muhammad Anwar Kasi issuing stay orders stopped Federal Board Of Intermediate & Secondary Education (FBISE) in conducting the final prize distribution ceremony after the two petitioners Saad Jan and Abeera Saeed challenged the allocation of top positions by the board.

The petitioner Saad Jan challenged before the court that he topped the board in humanities group by securing 927 marks while the FBISE declared one Sara Noor as the top position holder who secured 914 marks.

Petitioner Saad Jan told the court that he is a student and took the higher secondary school certificate (HSSC) exam through Askaria College (Boys Wing) held under the control of FBISE as a regular student vide roll number 502277, in humanities group. Petitioner scored 927 highest marks out of 1100 while Sara Noor obtained 914 marks in humanities groups under Roll no. 515982. FBISE instead of declaring the petitioner as top position holder, declared Sara Noor as first position, which is against in clause-d of rules 1.19 of the FBISE declaration of top position.

Second petitioner Abeera Saeed challenged before the court that she appeared in HSSC examination through Askaria College (Girls wing) held under the control of FBISE as a regular student vide roll number 578400, in general science group and obtained 1010 marks out of 1100. Abeera told the court that one Faiza Ahmed Khan from Army Public School and College, Jehlum Cantt.

Roll no. 577945 obtained 1011 marks and took the first position in the board in the General Science Group, whereas one Novera Tahir roll number 579349 secured 1010 marks, which are equivalent to the marks obtained by the petitioner. As per the practice, custom of the FBISE the second position has to be shared among the petitioner and the respondent Novera Tahir, but unfortunately the FBISE instead of declaring the petitioner as holder of the second position in the board in general science group declared Novera Tahir as alone second position holder.

The court, while issuing stay orders, issued notices to the respondents FBISE, Askaria College, Sara Noor and Novera Tahir.

Saad Jan told the court that on this discrimination he contacted the FBISE and requested them to declare the petitioner as the first position holder in humanities group, but the FBISE did not adhere to the request of the petitioner and made a flimsy ground that the petitioner has opted for the facility of reappearing in one paper of first year, therefore, he is not entitled for the declaration of the position. The second petitioner Abeera Saeed told the court that the board replied her the same by saying that she opted for reappearing in two papers of first year and she is not entitled for the second position.

Both the petitioner submitted before the court that as per the board policy the eligibility criteria for the declaration of top position is that the candidate should pass the examination in a single attempt and the petitioners completed their HSSC annual examination 2013 in a single attempt, which fulfil the criteria and same is also mentioned in result cards of the petitioner as “he/she has passed the examination in single attempt.” Petitioners prayed to the court to direct the FBISE to declare them as first and second position holders respectively. They also prayed to the court to stay the final prize distribution ceremony.

The court after issuing the above said order put of hearing with date in office. (TheNews)
